Parentage testing

Assessment criteria

For legal aid to be granted for parentage testing in matters not relating to child support, the following tests must be satisfied:

  • The applicant meets the means test, and
  • The applicant meets guideline 8 – paternity, and
  • The applicant is currently in receipt of legal aid for a parenting dispute and/or property settlement, and
  • Either of the following applies:
    •  
    • There is a court order for parentage testing, and/or
    • There is a written agreement for parentage testing (eg parenting plan), and
  •  
  • The applicant meets the merits test.

Requirements

Extension of aid requests received from a preferred supplier or in-house practitioner

Practitioners seeking a grant of legal assistance should electronically submit an application for aid via the Grants Online system

The following documents are retained on file but may be requested by Legal Aid Queensland:

  • a copy of the court order for paternity testing (if applicable), or
  • a written agreement for parentage testing (if applicable).

Grant(s) of aid

  • The grant of aid to arrange parentage testing is PTG.
  • The grant of aid to obtain a standard parentage test is DNA1.
  • The grant of aid to obtain an additional standard parentage test is DNA2.
  • The grant of aid to obtain an overseas parentage test in Asia is DNA3.
  • The grant of aid to obtain a overseas parentage test for the rest of the world is DNA4.

Review of decisions

A decision to refuse legal aid for this type of matter may be appealed to the external review officer (refer to review of decisions).
