For legal aid to be granted for the separate representation of children at QCAT the following tests must be satisfied the matter meets the merits test.
All applications received for the separate representation of children in QCAT proceedings will be referred a grants manager for consideration.
Documentary requirements
A copy of the order made by QCAT pursuant to the Child Protection Act 1999.
Grant(s) of aid
The grant of aid for a separate representative to peruse filed material is KCSR.
Extension(s) of aid
The following extensions of aid are available for a separate representative to:
- KCS1 - Attend to negotiation/case planning.
- KCS3 - Attend preliminary conference.
- KCS4 - Prepare and attend day one of a hearing at QCAT.
- KCS5 - Attend additional days of hearing at QCAT.
Review of decisions
A decision to refuse legal aid for this type of matter may be appealed to the external review officer (refer to review of decisions).
